Terms & Conditions

Article 1 – General

 

1.1 These terms and conditions apply to all offers, quotes, services, agreements, and deliveries by BHV Caribbean, located in Willemstad, Curaçao.

1.2 By using our services, you agree to these terms and conditions.

1.3 Any deviations from these terms are only valid if agreed upon in writing.


 

Article 2 – Services & Courses

 

2.1 BHV Caribbean provides certified training in emergency response (BHV), first aid (EHBO), CPR/AED, firefighting, and evacuation.

2.2 Our standard BHV courses consist of 1 to 2 days of practical and theoretical training.

2.3 Students who pass the exam receive a recognized diploma, checked and approved according to the NIBHV guidelines.

2.4 If a participant fails the exam, they have the opportunity to retake the exam for an agreed-upon fee.

2.5 One year after completing the course, the company or participant must take a refresher course to maintain the validity of the certificate.


 

Article 3 – Fire Drill

 

3.1 BHV Caribbean offers a Fire Drill service that includes a maximum of three physical visits to the company’s location.

3.2 The procedure is as follows:

  • First visit: analysis of the evacuation plan, check of existing emergency systems, and general safety situation.

  • Second visit: evaluation of whether the advised improvements have been implemented. If approved, the Fire Drill will be conducted.

  • Third visit (if necessary): a final chance to meet the requirements and successfully complete the Fire Drill.

3.3 If the company fails the evacuation drill after three visits, it will receive a poor rating and must restart the entire Fire Drill process for a new fee.


 

Article 4 – Liability

 

4.1 BHV Caribbean is not liable for any damage of any kind resulting from participation in a course or training session, unless there is intent or gross negligence.

4.2 Participation in training is at the participant’s own risk.

4.3 It is the client’s responsibility to provide accurate and complete information about employees, location, and safety risks.


 

Article 5 – Payment & Cancellation

 

5.1 Invoicing takes place before or immediately after the training session.

5.2 Payment must be made within 14 days of the invoice date.

5.3 For cancellations up to 5 business days before the start of the training, no costs will be charged. For cancellations within 5 business days, 50% of the course fee is due. For cancellations within 24 hours, the full amount is due.

5.4 Rescheduling training sessions is possible in consultation and depends on availability.


 

Article 6 – Force Majeure

 

6.1 In the event of force majeure (such as natural disasters, pandemics, unforeseen government measures), BHV Caribbean has the right to suspend or cancel the agreement without being liable for damages.

6.2 In such a case, BHV Caribbean will always attempt to offer a suitable solution or an alternative date.


 

Article 7 – Intellectual Property

 

7.1 All course materials, documents, and presentations remain the property of BHV Caribbean and may not be copied, distributed, or used without written permission.

7.2 It is forbidden to reuse these materials for commercial purposes.


 

Article 8 – Complaints Procedure

 

8.1 Complaints must be reported in writing within 7 days of the training’s conclusion by emailing info@bhvcaribbean.com.

8.2 BHV Caribbean aims to provide a substantive response and offer a solution to complaints within 5 business days.


 

Article 9 – Applicable Law

 

9.1 Curaçao law applies to all agreements between BHV Caribbean and the client.

9.2 In the event of disputes, the court in Willemstad has jurisdiction.
